JUDGEMENT Rakesh Kumar and j. JJ. 1. When the case was called out, it was jointly submitted that during the pendency of this petition, compromise in between the petitioners and opposite party no.2 has arrived. 2. Mrs. Renu Jha, learned counsel appearing on behalf of opposite party no.2, submits that outside the court due to intervention of the well wisher, the dispute in between the parties has already settled and the complainant further does not want to proceed with the complaint case. 3. In view of the statement made by learned counsel for opposite party no.2 at the Bar, it would not be appropriate to allow further continuance of proceeding in Complaint Case No.49 of 1998, pursuant to the order of cognizance dated 16.2.1998. 4. Accordingly, the order of cognizance dated 16.2.1998 is hereby set aside and the petition stands disposed of. 5. In this case, lower court record has been received. Let the same be sent back to the court below forthwith.
