JUDGMENT Rakesh Kumar Garg J. (Oral):- This is defendant’s second appeal challenging the impugned judgment and decrees whereby plaintiffs suit for recovery was decreed with interest @ 12% per annum till its realization. 2. At the time of motion hearing, learned counsel for the appellant had raised his grievance with respect to rate of interest only. On March 11, 2010, this court finding that there could be amicable settlement directed the parties to be present in the Court. 3. Today, the parties are present in the Court. 4. With the intervention of the learned counsel for the parties, the parties have agreed to settle their dispute on payment of a sum of Rs.60,000/- in total. It has been further agreed that the aforesaid amount of Rs.60,000/- shall be paid by the appellant to the respondent in three equal instalments i.e. the first instalment shall be paid on or before 21st April, 2010. The second instalment shall be paid on or before 15th June, 2010 and the last instalment shall be paid on or before 15th July, 2010. It is made clear that no further interest shall accrue to the respondent if the amount of Rs.60,000/- is paid as aforesaid. In case of any default in the payment as aforesaid, this appeal shall be deemed to be dismissed and the respondent shall be entitled to execute the decree in accordance with the law. With the aforesaid observations, this appeal stands disposed of. 5. Till 15th July, 2010, the execution pending before the trial Court are ordered to be kept in abeyance. However, on committing default in payment of 1st instalment the stay order shall also be deemed to be vacated. ------------------
