Judgment : One of the issues is the non-payment of any compensation to the thirteen crew members of the vessel 'Jupiter Six'. Three of them were Ukrainian nationals and according to respondents 4 and 5, they have been paid compensation by the owners of the vessel. Out of ten Indian seamen, four are officers and six are non-officers. It is stated that in regard to one of them, that is Subhash Das, compensation of 25000 US dollars was paid to Mrs. Rupa Das, his widow. In regard to the other nine Indian seamen, that is four officers and five non-officers, it was submitted on behalf of respondents 4 and 5 that the owners have voluntarily come forward and offered to pay a compensation @ 40000 US Dollars for each of the officers and 25000 US Dollars for each of the non-officers, totalling to 285000 US Dollars. It is stated that the payment is being made by M/s. James Mckintosh Company Pvt. Ltd., Mumbai on behalf of the owners of the vessel. It is made clear that the deposit on behalf of the owners and acceptance by the seamen will be without prejudice to their respective contentions and the claims for higher compensation by the LRs of the crew. The said sum of 285000 US Dollars shall be deposited in this Court within three weeks from today. Thereafter, appropriate orders for disbursal would be made.
