Hon'ble GANDHI, J.—This appeal is directed against the order dated 03.08.2009 passed by the learned Single Judge in S.B. Civil Writ Petition No. 8595/2009, whereby the writ petition has been dismissed. 2. The petitioner filed an application for calling Dr. P.C. Joshi to prove his disability certificate. His application came to be dismissed. The petitioner challenged this order by way of writ petition and the writ petition has been dismissed by the learned Single Judge. This appeal has been filed against the order of the learned Single Judge on the ground that the order of the learned Single Judge is erroneous. Any order passed by the Tribunal can be challenged ultimately by way of appeal and if the misc. appeal was not filed, it can be challenged setting up it as a ground at the time of filing appeal against the final order of the Tribunal. 3. We do not find any illegality committed by the learned Single Judge in dismissing the writ petition. 4. The appeal being devoid of merit is dismissed.
