ORDER : Petitioner by Mr. Jitendra Singh, advocate. Respondent by Mr. Mukund Bhardwaj, GA. 2. Being aggrieved by the order dated 21-7-2009 passed by I Additional Sessions Judge, Ashok Nagar in ST. No. 193/2009 whereby the charge has been framed against the petitioner for an offence punishable under sections 332, 333, 386, 427 of Indian Penal Code, the present petition has been filed. 3. Learned counsel for the petitioner submits that the alleged injuries which have been caused by the petitioner were not grievous in nature, therefore, no charge under section 333 of Indian Penal Code is made out. It is submitted that in the facts and circumstances of the case, petition filed by the petitioner be allowed and the impugned order passed by the learned trial Court be set aside. 4. Learned counsel for respondent submits that the injuries caused by the petitioner were grievous in nature, therefore, learned trial Court rightly framed the charges. It is prayed that the petition filed by the petitioner be dismissed. 5. After taking into consideration all the facts and circumstances of the case and keeping in view that the injuries were caused by kicks and fists and the nature of the injuries were not grievous in nature, this Court is of the view that the learned Court below committed error in framing the charge under section 333 of Indian Penal Code. Hence, petition filed by the petitioner is allowed in part and the charge framed under section 333, Indian Penal Code is set aside. 6. With the aforesaid observations, petition stands disposed of C.C. as per rules.
