JUDGMENT Ram Chand Gupta, J.(Oral).:- The present petition has been filed by Rohit Sahota and Fateh Singh for anticipatory bail under Section 438 of Code of Criminal Procedure in cross case registered under Sections 323/324/325/326/341/34 IPC against FIR No.189 dated 07.10.2009 under Sections 307/323/324/336/148/149 IPC and 25/54/59 of Arms Act, registered at P.S. Samrala, District Ludhiana. 2. I have heard learned counsel for the parties and have gone through the whole record. 3. This Court while issuing notice of motion on 04.03.2010 passed the following order:- “Argues that it is a case of version and cross-version and the main FIR for offences under Sections 307, 232, 234, 336, 341, 148, 149 IPC and under Section 25/54/59 of the Arms Act was registered against the complainant party by the brother of petitioner No.1 and that the petitioners have been involved on the basis of cross-version given by one of the accused in the main FIR, namely, Manpreet Singh. Notice of motion for 6.4.2010. However, petitioners are directed to join the investigation and in case they are arrested, they shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438(2) Cr.P.C.” 4. It has been stated by learned counsel for the petitioners that petitioners have already joined the investigation pursuant to said order dated 04.03.2010. 5. It has also been stated by learned counsel for the State, on instruction from HC.Prem Singh, that petitioners have joined the investigation and that they are no more required for any custodial interrogation. 6. There are no allegations on behalf of the State that petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 7. Hence, in view of these facts and without expressing any opinion on the merits of the case, the anticipatory bail application filed by Rohit Sahota and Fateh Singh is accepted and order dated 04.03.2010 granting interim bail to the petitioners, is hereby made absolute subject to compliance of conditions specified under Section 438(2) Cr.P.C. The present petition stands disposed of accordingly. —————
