JUDGMENT S.S. Saron, J.:- Cr. M. No.18964/2010 : The hearing of the case is preponed to today. The criminal miscellaneous stands disposed of. Cr. M. No.M-7983/2010: Heard learned counsel for the petitioner. 2. The petitioner seeks pre-arrest bail in a case registered against him for the offences under Sections 420, 467, 468, 471 and 120-B IPC. 3. The FIR in the case has been registered on the statement of Balkar Singh. It is alleged that Kundan Lal son of Baru Ram in the year 1936 had given the complainant 4 acres of land as donation. They have been cultivating the land since their predecessors-in-interest. In 1975 Kundan Lal filed a civil suit against the complainant to seek their eviction. However, the suit was dismissed. Thereafter, Kundan Lal died on 8.12.1982. Since then no litigation has been initiated against the petitioner by any body in any Court. The complainant came to know that Madan Lal son of Sarup Ram by getting some one impersonated as Kundan Lal as well as his daughters Parmatma Devi, Maya Devi, Indira and Gianwati has got sale deed executed in respect of the aforesaid land in favour of his (Madan Lal’s) wife Narinder Kaur. The land has been sold. A number of persons are alleged to be involved in the conspiracy. 4. Learned counsel for the petitioner has submitted that in respect of the sale deed dated 22.5.2008 which has been executed in favour of Narinder Kaur, the wife of Madan Lal, the petitioner is only an attesting witness and he is not a beneficiary of the transaction. Besides, two Lambardars who had attested the sale deed have not been arrayed as accused. 5. After giving my thoughtful consideration to the matter, it may be noticed that Kundan Lal had died on 8.12.1982. Thereafter, Madan Lal got someone to impersonate as Kundan Lal as well as the daughters of Kundan Lal, namely, Parmatma Devi, Maya Devi, Indira and Gianwati. Through them he got a sale deed executed in favour of his wife Narinder Kaur. Later on Narinder Kaur sold the land. A false sale deed was executed by producing some body who had impersonated as Kundan Lal who had in fact died on 8.12.1982 and the sale deed was executed on 22.5.2008.

The involvement of the petitioner in attesting the sale deed of a person who had died almost 26 years earlier would require consideration and investigation by the Police. The fact that two Lambardars had identified the seller and had not been arrayed as an accused would not absolve the petitioner of the wrong committed by him. In the circumstances, there is no merit in this petition and the same is accordingly dismissed. ------------
