Judgment :- The prayer in the writ petition is issue a direction, directing the respondents herein to refix the scale of pay of the applicant as per V pay commission and sanction him earned leave for the past 12 years and consequentially direct the respondents to sanction the applicant his advance increments as per G.O.Ms.604 dated 07.04.1988 and direct the respondents to pay all the monetary benefits due to the applicant with 12% market rate of interest on the delayed payment with all consequential service benefits. 2. Memo dated 03.02.2000 is filed by the counsel Mr.S.Ravi stating that he has returned the bundle and he has also given concern for change of vakalat. The matter is listed today (i.e.) 04.02.2010 by printing the name of the petitioner. There is no representation. 3. In the memo filed by the counsel, he has clearly stated that the papers were returned on 09.01.2007 and the petitioner has also acknowledged the same on that date. The letter of the petitioner is also enclosed with the memo. In such view of the matter, since the petitioner has not shown any inclination for disposal of the case on merits, the same is dismissed for non-prosecution.
