ORDER : 1. Leave granted. 2. We have heard the learned counsel for the parties. 3. We modify the order of the Division of the High Court of Uttarakhand that has been impugned herein to the extent that the election will be conducted under the supervision of some Government official to be nominated by the Director (Education) concerned of the State of Uttarakhand within one week from the date of supply of a certified copy of this order to the Director. We also direct that the annual membership fee which will be deposited along with the form shall be Rs. 51/-and not Rs. 625/-but all the other conditions for the conduct of the elections will be as per the advertisement Annexure – P7 dated 28th April, 2009. We also direct that in view of the aforesaid circumstances a fresh advertisement in terms of the advertisement dated 28th April, 2009 with the necessary modifications as per this order will also be issued within thirty days from the date noted above.. We also direct that the election process will be completed within a period of four months from today and for that purpose all parties will contact the persons nominated by the concerned Director. 4. All the records pertaining to the election will be handed over by the Management to the nominated person as soon as he is nominated. 5. The appeals are disposed of in the aforesaid terms. Dasti order.
