Judgment :- 1. prayer in the writ petition is for issuance of writ of mandamus directing the respondents forthwith include the petitioners varied route Pondicherry to Madras via. Kilianur, Tindivanam in the interstate agreement dated 19.04.1985 or in the alternative to amend the interstate agreement by adding the petitioner varied route Pondicherry to Madras via. Kilianur, Tindivanam is concerned as per Clause VI. 2. Mrs. Radha Gopalan, the learned counsel for the petitioner would submit that due to certain subsequent developments which had taken place during the pendancy of the writ petition the prayer as sought for need not be granted at this stage. It is brought to the notice of this Court that the Pondicherry State by gazette notification dated 18.12.2009 has notified a draft agreement for plying of state carriage services on interstate roads between State of Tamil Nadu and Union Territory of Pondicherry. It is also submitted that the first supplemental reciprocal draft agreement has also been notified by the Governement of Tamil Nadu by Gazette notification dated 18.12.2009. In terms of the said notification the hearing to be conducted has been fixed on 25.01.2010. In this regard the petitioner has submitted a representation dated 12.01.2010, to the first respondent, wherein the petitioner has requested the competent authority to include the petitioners varied interstate route between Pondicherry to Chennai via. Kilianur and Tindivanam in the interstate agreement to be entered into between the Government of Tamil Nadu and Government of Puducherry. The said representation has been sent by speed post on 12.01.2010. Along with the representation the petitioner has enclosed certain documents in support of his contentions. 3. Therefore, at present writ petitioner seeks for issuing appropriate directions to the first respondent to take into consideration the representation dated 12.01.2010 when the enquiry is to be held on 25.01.2010 on the first supplemental reciprocal draft agreement between Government of Tamil Nadu and Government of Puducherry as notified in the gazette dated 18.12.2009. 4. Hence, taking into consideration the submissions made by the learned counsel for the petitioner there will be direction to the first respondent to consider the petitioners representation dated 12.01.2010 while considering the first supplemental reciprocal draft agreement and to pass appropriate orders on merits, in accordance with law. 5. With the above direction this writ petition is disposed of. Consequently M.P.No.1 of 2006 is closed.
