JUDGMENT 1. This suo-motu writ petition was registered on the basis of news item that appeared in a daily newspaper 'Rajasthan Patrika' in its issue dated 08.02.2010 under caption "Sewanivrata Krishi Shikshak-Karmchari Do Maaha Se Pareshan - 1100 Ko Pension Nahi". 2. From perusal of that news item it appears that 1100 personnel of various categories such as Lecturers and other employees, who retired from service of Swami Keshvanand Rajasthan Agriculture University, Bikaner and Maharana Pratap Technical & Agriculture University, Udaipur were not being paid pension for last two months whereas, this was the only source of income and despite number of representations made, the Universities/State of Rajasthan have not taken any action in the matter. 3. Shri S.S. Manohar, one of retired employees of Swami Keshvanand Rajasthan Agriculture University, Bikaner, appeared in person to support the petition. 4. Officer-in-charge, appearing on behalf of respondent University, informed the Court that pension of retired employees for the month of August, 2010 has been released and the Government has been approached for sanctioning necessary fund so as to make payment of arrears to them. So soon the sanction is received from the Government, payment of the due amount shall be made to such employees. 5. Shri S.S. Manohar, however, submitted that not only the arrears of several months has not been paid to retired employees but they have also not been granted benefit of revision of pension consequent upon acceptance of recommendation of 6th pay commission, which the Universities have proposed to implement for its non-teaching staff from 01.01.2007 and teaching staff from 01.01.2006. The respondents may be directed to pay them arrears thereof with reasonable rate of interest. 6. Having regard to nature of controversy and keeping in view of the fact that it has not been disputed by respondents that retired employees are entitled to pension as also arrears thereof, the respondents Universities and the State of Rajasthan are directed to pay them all arrears including all benefits payable to them consequent upon implementation of recommendation of 6th pay commission together with interest at the rate of 6% per annum, within a period of three months. 7. Writ petition accordingly stands disposed of with aforesaid directions.Writ Petition Disposed of as Above. *******
