This petition by Ritu Monga, petitioner, has been filed under Section 482 of the Code of Criminal Procedure for issuance of direction to the respondents for registration of the FIR and for arresting the accused. 3. It has been submitted by learned counsel for the petitioner that a written application was sent to the Officer Incharge of the Police Station for the registration of the FIR, but no action was taken and that a written application was also given to the SSP of the concerned district, but the FIR was still not registered. 4. According to the petitioner, her daughter, who was a student of 10+1 class of R.S.Model School, Model Town Ludhiana, committed suicide and her death took place in DMC on the morning of 28.10.2008 and thereafter, on the search of her school bag, one suicide note was found in which she had accused the Principal and few teachers; namely Mr. Mohan Kalra, Mrs. Anju Talwar, Mrs. Balwinder Sodhi and Mrs. Jatinder Kaur, responsible for her death. 5. A copy of the suicide note has also been filed as Annexure P-l with the petition. The only allegation levelled in that suicide note is that the above said persons had rusticated her from the school. That cannot be said to be such an instigation, which falls under the definition of abettment, as contained in Section 109 IPC. As such, it cannot be said that any such cognizable offence is made out from the applications moved by the petitioner before the Officer Incharge of the police Station and the SSP of the concerned district. Therefore, they were not obliged to record the FIR or to conduct the investigation as required by Section 154 (3) Cr.P.C. Petition is dismissed accordingly.
