JUDGMENT 1. - Instant petition has been filed by petitioner assailing order dated 23/02/2005 whereby the issue in regard to personal & bonafide need of the plaintiff (respondent-3) was decided against tenant (petitioner); and the Rent Appellate Tribunal on appeal being preferred U/s 19 of Rajasthan Rent Control Act, 2001 ("the Act, 2001"), affirmed the finding recorded by the Rent Tribunal in regard to the issue of personal & bonafide need, while rejecting the appeal vide judgment dated 20/05/2010. 2. Counsel for petitioner basically laid much stress that Dharamveer who is plaintiff's witness, in cross examination has completely denied personal & bonafide need of plaintiff l lord; and the finding recorded by Rent Tribunal & Appellate Rent Tribunal based on the evidence of Dharamvir is totally perverse and beyond pleadings and that apart being not supported by the evidence on record; which requires interference by this Court. Caveat has been entered on behalf of respondent-3 whose Counsel submits that the finding recorded by both the Tribunals are duly supported by pleadings and evidence on record and that apart, concurrent finding under judgments impugned in regard to the issue relating to personal & bonafide need; in such circumstances, in absence of any apparent perversity, this Court would not like to interfere in its limited scope of judicial review U/Art.227 of the Constitution. 3. The issue relating to personal & bonafide need has been examined in details by Rent Tribunal and finally it has been held that respondent plaintiff has personal & bonafide need seeking eviction of petitioner from the rented premises, which has been duly affirmed by Rent appellate Tribunal while rejecting the appeal preferred by petitioner vide judgment dated 20/05/2010. 4. This Court has gone through the concurrent finding of fact recorded by Rent & appellate Tribunal on the issue relating to the personal & bonafide need of respondent-plaintiff; and taking note whereof, does not find manifest error being committed by both the Tribunals which may call for interference. 5. Before parting with the order, this court considered it appropriate to grant reasonable time to the tenant for handing over peaceful & vacant possession so as to enable him to find out alternative accommodation because of rented premises being residential; but that was declined by petitioner's Counsel. 6. Consequently writ petition fails and is hereby dismissed. No costs.APR215 Petition Dismissed. *******
