JUDGMENT 1. - As per the averments contained in petition for writ the Bhagwan Minor Canal constructed by the State Government had certain technical defects and a recommendation was made by the competent committee to get those defects rectified. A survey of the canal was made and necessary approval was given to get the necessary work done to make natural flow level of water available. 2. The submission of the petitioner is that the rectification work done under the supervision of the respondents No.1 to 5 is not appropriate and consequent to that un-command area has been raised. It is also submitted that the respondents instead of removing the defects pointed out by the competent committee are just doing formalities and no work is done that is appropriate for adequate flow of water in canal. 3. With the factual averments aforesaid, a direction is sought for the respondents to rectify the defects of Bhagwan Minor Canal in a just manner. 4. The grievance of the petitioner is purely of technical nature and that is required to be redressed at administrative level by taking adequate assistance of technical experts. The grievance sought to be redressed cannot be adequately examined by this Court while exercising extra-ordinary powers of this Court. In such circumstances, I do not consider it appropriate to interfere in the matter while exercising powers under Article 226 of the Constitution of India. However, looking to all set of facts, I deem it proper to direct the respondents to consider the grievance of the petitioner adequately within a period of two months from today, if he forwards a copy of this writ petition to the Chief Engineer, Water Resources (North), Hanumangarh Junction on or before 29.10.2010. The Chief Engineer shall consider this petition as a representation submitted by the petitioner. 5. The petition for writ stands disposed of.Writ Petition Disposed of as Above. *******
