JUDGMENT Rajesh Bindal, J.:- Challenge in the present revision petition is to the order dated May 5, 2010 passed by learned Court below whereby the evidence of the petitioner/plaintiff was closed by order of the Court. 2. Learned counsel for the petitioner submitted that though sufficient opportunities were granted to the petitioner for concluding his evidence, however, due to unavoidable circumstance, the same could not be completed. He prays for grant of one opportunity to conclude the same. 3. After hearing learned counsel for the petitioner, I do not find any merit in the submissions made. The suit was filed way back on May 27,2004. It was still at the stage of plaintiff’s evidence when the impugned order was passed. A perusal thereof shows that on previous date, learned counsel for the petitioner had made a statement that he will produce entire evidence on the next date, otherwise, the same may be closed by order. It may further be noticed that on previous seven dates last and final opportunities were granted. 4. Considering the aforesaid facts, I do not find any reason to interfere with the impugned order. The revision petition is accordingly dismissed. ------------
