JUDGMENT 1. - Heard learned counsel for the petitioner. 2. It is contended by learned counsel for the petitioner that against the judgment of Addl. Chief Judicial Magistrate, Anoopgarh, District Sriganganagar dated 21.08.2010 passed in criminal case no. 608/1996 whereby the petitioner was convicted for commission of offence under Sections 419, 420, 465, 467, 468, 471 I.P.C, against which he preferred an appeal before the appellate Court and filed an application for suspension of sentence. However, learned appellate Court rejected the application filed by the petitioner for suspension of sentence while admitting the appeal and the said appeal is pending and petitioner is behind the bars. 3. In this view of the matter, this misc. petition is allowed and the order dated 28.08.2010 passed by Addl. Sessions Judge, Anoopgarh is hereby quashed and set aside. The sentence awarded by the Addl. Chief Judicial Magistrate, Anoopgarh District Sriganganagar against the petitioner vide judgment dated 21.08.2010 is hereby suspended and appellate Court is directed to release the petitioner upon furnishing a personal bond in the sum of Rs. 20,000/-and two sureties of Rs. 10,000/- each to the satisfaction of the appellate Court on usual conditions. It is made dear that the petitioner shall appear before the appellate Court on regular dates till disposal of the appeal and as and when required to do so.Petition Allowed. *******
