JUDGMENT 1. - Heard learned counsel for the parties.On having considered the overall facts and circumstances of the case as well as the material on record, including the documents of the Revenue Department and on considering the fact that the complainant Ramavtar is the son of petitioner No. 1 and has filed the present case oft the ground that ancestral property has been sold by the father, I deem it just and proper to grant indulgence of anticipatory bail to the petitioners.Consequently, the application for anticipatory bail is allowed. 2. The S.H.O./I.O./Arresting Authority, Police Station Kotwali, District Jhunjhunu in F.I.R. No. 306/2010 is directed that in the event of arrest of the petitioners (1) Ram Niwas S/o Manni Bai @ Mani Ram; (2) Chandra Prakash S/o Ram Niwas and (3) Ganesh S/o Late Rajendra Kumar, they shall ha released on bail, provided each of them furnishes a personal bond in the sum of Rs. 50,000/- with two sureties in the sum of Rs. 25,000/- each on his satisfaction on the following conditions : (i) that the petitioners shall make themselves available for interrogation by a police officer as and when required; (ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and (iii) that the petitioners shall not leave India without previous permission of the court.
