Judgment :- The Writ Petition is for a direction to the respondents to permit the petitioner to retire from service and disburse all the terminal benefits within short date that may be fixed by this Honourable court. 2. When the matter came up before this Court on 23.3.2010, this Court directed the learned Additional Government Pleader to take notice and to find out why the order passed by this Court in W.P.Nos.10095 of 2008 and 38061 and 38062 of 2005 dated 30.7.2008 is not yet implemented. By the aforesaid order, this Court set aside the orders impugned therein and directed the respondents to pass order retiring the petitioner from service, if there are no other legal impediment. Despite the order passed as early as July 2008, there was no order by the respondents. Hence, the petitioner has filed the present Writ Petition. Therefore, this Court wanted to know the fate of the earlier order passed by this Court dated 30.7.2008 and the matter may be directed to be posted on 29.3.2010. 3. Subsequently, the matter stood adjourned to 6.4.2010 at the instance of the learned Additional Government Pleader. When the matter came up on 6.4.2010, since there was no response on the side of the respondents and the learned Additional Government Pleader is unable to state the stand of the Government, this Court directed the Commissioner for Agriculture, Chepauk, Chennai to appear before this Court as to why appropriate contempt proceedings should not be initiated for violating the orders of this Court. 4. Today, when the matter is called, Mr.N.Senthil Kumar, learned Additional Government Pleader stated that the Commissioner of Agriculture has been deputed for four weeks training duty and he has gone abroad and therefore, he is unable to be present before this Court. The Deputy Director (Administration) from the Department is present. He also brought to the notice of this Court that the Government has passed an order in G.O.(3D) No.64, Agriculture Department dated 9.4.2010 dropping the charges framed against the petitioner and also G.O.(3D) No.65, Agriculture Department dated 9.4.2010 revoking the order of suspension. 5. In the light of the above, it is unnecessary to entertain the Writ Petition. It is needless to state that the respondents will expedite the settlement of the terminal benefits without driving the petitioner once again to move this Court for further direction.
