JUDGMENT Gurdev Singh, J.:- Heard. 2. Petitioner—Kuldeep, who is standing his trial before the Additional Sessions Judge, Faridabad, for the offences under Sections 147, 148, 307, 506 of the Indian Penal Code and Section 25 of the Arms Act, 1959, and in respect of which FIR No. 40 dated 26.1.2009 was recorded in Police Station Sector 31, Faridabad, has come up with the present petition under Section 439(1) of the Code of Criminal Procedure for grant of regular bail. 3. The petitioner had come up with the similar petition for bail (Crl. Misc. No. M- 8310 of 2010) which was dismissed by this Court on 22.3.2010 keeping in view the gravity of the offences and the circumstances in which the same was committed. However, according to the counsel for the petitioner there is change in the circumstances since the dismissal of that petition as after that date all the prosecution witnesses have been examined and they have resiled from their previous statement. 4. It was on the statement of Amar Lal that the FIR was registered and according to him he was given beatings by the present petitioner. The present petitioner and the other accused started beating him by holding him from his neck and Anil tried to stop them from doing so. The present petitioner took out a country made pistol and fired a shot, which hit the stomach of that Anil. Statements of the complainant and the injured, which were recorded before the trial court have been annexed with the petition as Annexures P-3 and P-2, respectively. 5. A perusal thereof shows that they resiled from their previous statement. They never stated that it was the present petitioner who caused injuries. 6. When such is the position, the petitioner is ordered to be released on bail to the satisfaction of the trial court, Faridabad. ------------
