JUDGMENT The petitioner seeks grant of anticipatory bail in case FIR No.62, dated 7.3.2010, registered under Sections 379/188 of the IPC, at Police Station Suraj Kund, District Faridbad. 2. Counsel for the respondent is not in a position to deny that the dumper of the petitioner and its driver were not apprehended at the spot (as has been recorded by the learned Addl. Sessions Judge, Faridabad in his order dated 14.5.2010) but the dumper was taken into possession on 28.4.2010. 3. Counsel for the petitioner states that no recovery etc. has been made from the petitioner and that he is ready to face the trial. 4. In these circumstances, in my opinion it would be in the interest of justice if the petitioner is granted the concession of anticipatory bail. Consequently, in the event of his arrest, the petitioner shall be released on anticipatory bail by the Investigating Officer to his satisfaction subject to the provisions of Section 438(2) of the Cr.P.C. This order will, however, enure up to the filing of the challan whereafter the petitioner will have to seek regular bail in accordance with law. Petition stands disposed of. ------------
