JUDGMENT 1. - This petition has been preferred by Rajpal @ Raju for release on first regular parole of 20-days 2. Notice was given to the learned counsel for the State. 3. A reply to the petition has been filed. 4. It is not in dispute that the petitioner is eligible as per rules for the grant of first regular parole of 20-days. 5. As per the report of the Superintendent of Jail concerned the conduct of the accused has been found to be satisfactorily. 6. The Social Welfare Officer has also recommended the case for release of the petitioner and has also stated that as per the views expressed by the residents of the Village there is no likelihood of any un towards incident occurring on account of the release of the petitioner on parole. 7. As per Annexure-1, the report of the Advisory Committee where the case of the petitioner was considered, the application of the petitioner was rejected primarily on the ground of adverse Police report. 8. Nothing specific apart from the fact that there may be danger to the life of the petitioner himself has been pointed out. 9. Having regard to the facts and circumstances, as mentioned above and keeping in view the principles laid down by this Court in the case of Pappu Khan v. The State of Rajasthan and Ors. , reported in 2006 (1) WLC (Raj.) 31 , we deem it just and proper to accept this writ petition for the grant of first regular Parole of 20-days to the petitioner. 10. Consequently, we allow this writ petition and direct the Superintendent, Central Jail, Jaipur to release the petitioner namely, Raj Pal @ Raju son of Shri Ram Karan by caste Jat, resident of Hardayalpura, Police Station Ramgarh Sethan Tehsil Fatehpur District Sikar on 1st regular parole for a period of 20-days, which shall commence from the date of his release, upon furnishing a personal bond for a sum of Rs. 50,000/- (Rupees fifty thousand only), along with two sureties of Rs. 25,000/- (Rupees twenty five thousand only) each to the satisfaction of the Superintendent, Central Jail, Jaipur, on usual terms and conditions, as determined by him. The Superintendent, Central Jail, Jaipur shall also fix a date for his surrender before the jail authorities. 11. The writ petition stands allowed with the aforesaid directions.Writ Petition Allowed. *******
