JUDGMENT 1. - These two writ petitions have been filed by Sube Singh and Rajendra Singh. Sube Singh is father of Rajendra Singh, both prisoners are undergoing their sentences and are presently lodged at District Jail, Alwar. Petitions are for grant of second regular parole for 30-days under Rule 9 of the Parole Rules of 1958. 2. It is not in dispute that both the petitioners have availed first regular parole of 20-days and have surrendered to the jail authorities, as per directions and conditions imposed. 3. Having regard to the facts and circumstances of the case, we would direct the Superintendent, District Jail, Alwar where both the petitioners are lodged to release the petitioners namely, Sube Singh son of Shri Khayali Ram and Rajendra Singh son of Shri Sube Singh on second regular parole for 30-days on usual terms and conditions subject to each of them furnishing a personal bond in a sum of Rs. 50,000/- with two sureties of Rs. 25,000/-. The Superintendent, District Jail, Alwar shall also fix a date for their surrender before the jail authorities. 4. It is further directed that the Superintendent will release Sube Singh son of Shri Khayali Ram first on parole and only in the event of Sube Singh son of Shri Khayali Ram surrendering himself at the end of the parole period of 30-days would Rajendra Singh son of Shri Sube Singh be released on second regular parole for 30-days. In case, Sube Singh fails to surrender in time Rajendra Singh shall not be released. 5. Both these petitions stand disposed of as above.Writ Petitions Disposed of. *******
