body2010
JUDGMENT Jaswant Singh, J (Oral). :- Crl.M.No.15922 of 2010 Application is allowed as prayed for. Crl.M.No.8836-M of 2010 Prayer is for grant of pre-arrest bail under Section 438 Cr.P.C in FIR No.517 dated 27.11.2009 under Sections 420/120-B IPC, Police Station Sadar, Amritsar. 2. It is stated that as per allegations, an amount of Rs.5.5 lacs was paid to the father, mother and brother of the petitioner-Aman for sending Harpreet Singh, son of the complainant-Sukhwant Singh to Cyprus. Allegations against the petitioner are that while residing in Cyprus she had given an assurance to the complainant that she would facilitate the immigration of Harpreet Singh to Cyprus for securing a job. Admittedly, there is no allegation against the petitioner that she received any amount on that account. 3. Learned counsel, thus, submits that the petitioner has no rule in the alleged commission of crime and nothing has to be recovered from her. It is further contended that the petitioner has a five months old child and that in pursuance of the earlier order passed by this Court, the petitioner has joined investigation. 4. Keeping into account the alleged role attributed to the petitioner and the fact that no recovery is to be effected from her, present petition is allowed and interim pre-arrest order dated 9.4.2010 passed by this Court is made absolute. ------------
