JUDGMENT Gurdev Singh, J.:- Crl. Misc. Nos. 33242-43 of 2010 Heard. Allowed subject to all just exceptions. Crl. Misc. No. M-2932 of 2010 Reply on behalf of the respondent has been filed in Court today and the same is taken on the record. 2. Heard. 3. Petitioners, Kulwinder Singh and Hardeep Singh @ Khaddu, have filed this petition under Section 439(1)of the Code of Criminal Procedure for grant of regular bail in FIR No. 115 dated 28.11.2008 registered under Sections 382, 325, 323 and 341 read with Section 34 of the Indian Penal Code in Police Station Sadar, Bathinda. 4. The petition has been opposed by learned State counsel on the ground that the petitioners are involved in similar type of cases, regarding which the FIRs were registered against them and the details thereof are given in the reply submitted by him today. 5. On the other hand, it has been contended by learned counsel for the petitioners that no such FIR was recorded against Hardeep Singh @ Khaddu-petitioner No. 2 and that similar situated co-accused; namely Jaswinder Singh has already been allowed bail by this Court vide order dated 20.4.2010 passed in Crl. Misc. No. M-6121 of 2009. 6. State counsel tried to assert that said Jaswinder Singh was not named as an accused in the other FIRs, which have been got registered against the present petitioners. 7. Except one of the FIRs, which have been annexed with the reply, Jaswinder Singh was also named as an accused along with petitioner No. 1. When the similarly situated accused has already been allowed the benefit of regular bail, the petitioners are also entitled to the benefit of bail on the basis of principle of judicial uniformity. 8. Accordingly, this petition is allowed and the petitioners are ordered to be released on bail to the satisfaction of the Illaqa Magistrate/Duty Magistrate, Bathinda. ------------
