JUDGMENT Gurdev Singh, J.:- Heard. 2. This petition under Section 482 of the Code of Criminal procedure has been filed been filed by Sanjeev Kumar, petitioner, for quashing of complaint No. 576 dated 2.8.2008 titled as “ICICI Bank v. Sanjeev Kumar and another(Annexure P-4) filed under Section 138 of the Negotiable Instruments Act, 1881, read with Sections 420, 406 read with Section 34 of the Indian Penal Code pending in the Court of Judicial Magistrate Ist Class, Bathinda and summoning order dated 12.8.2008 and the consequent proceedings. 3. According to the petitioner, the courts at Bathinda have no jurisdiction to entertain the complaint and to take cognizance of the offences mentioned therein. Even if it is so, it cannot be made a ground for quashing the complaint. 4. According to Section 201 of the Code of Criminal Procedure, if a complaint is made to a Magistrate, who is not competent to take the cognizance of the offence, he shall- (a) if the complaint is in writing, return it for presentation to the proper Court with an endorsement to that effect; (b) if the complaint is not in writing, direct the complainant to the proper Court. 5. In these circumstance, the petitioner is to take the plea of jurisdiction before the Judicial Magistrate Ist Class, Bathinda In case he comes to the conclusion that he has no jurisdiction then he is to follow the procedure as laid down in the above said Section. Petition is disposed of accordingly. --------------
