JUDGMENT Ram Chand Gupta, J.(Oral):- The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.38, dated 11.2.2010, under Sections 448, 511, 419, 420, 465, 467, 468, 471, 120-B IPC, registered at Police Station Sarabha Nagar, District Ludhiana. 2. I have heard learned counsel for the petitioner and have gone through the whole record carefully. 3. Brief allegations against petitioner-accused are that some unknown person impersonated complainant-Manjit Singh and executed a forged power of attorney in favour of Gurmit Singh who later on sold the said land on the basis of forged power of attorney in favour of Jaswinder Singh for a consideration of Rs.17.15,000/- on 13.11.2009. Hence on the identification of the petitioner-accused, being Namberdar, the forged power of attorney was registered by the Sub Registrar. 4. Hence, it is not such a case in which extraordinary relief of anticipatory bail should be granted to the petitioner-accused. Rather, custodial interrogation of the petitioner-accused is necessary. 5. Hence, in view of these facts, and without expressing any opinion on the merits of the case, the present petition filed by petitioner-Buta Singh for grant of anticipatory bail is, hereby, dismissed being devoid of any merit. ------------
