JUDGMENT M.M.S. Bedi, J.:- This order will dispose of the present petition for pre-arrest bail, filed by Nasib Kaur and Mohinder Kaur, mother and sister-in-(bhabi), respectively of deceased Hardeep Singh, apprehending arrest in a case registered at the instance of Harvinder Kaur wife of deceased Hardeep Singh alleging that her husband had been given beatings by her father-in-law along with others, resulting in his death on 12.6.2008. 2. Learned counsel for the petitioners has contended that the petitioners have been falsely involved in the case by daughter-in-law of petitioner No.1 and that as a matter of fact, Hardeep Singh had died in an accident while going on a scooter and he was lifted by volunteers of Sahara Jan Sewa of Bathinda and admitted in the hospital at Bathinda. The allegation of the complainant that her husband had been beaten on June 5,6,7 and 9, 2008 is absolutely false. 3. Learned counsel for the complainant has intervened to oppose the present petition for pre-arrest bail. He has contended that the complaint had been filed by the deceased on 9.6.2010 in the office of SSP Bathinda against his parents, which is indicative of the fact that the petitioners are involved in the murder of Hardeep Singh. 4. Learned State counsel informs that challan in this case has been presented u/s 304 A IPC and charge has already been framed u/s 302 IPC against the accused persons. The occurrence, in the present case, is of June, 2008. Petitioner No.1 is mother of deceased and petitioner No.2 is sister-in-law of deceased. The husband of petitioner No.1, who had allegedly inflicted an iron rod blow on the head of Hardeep Singh, is already in custody. It will certainly be a moot point during trial whether petitioner No.1 has inflicted injuries on the person of her son to kill him, as allegedly by daughter-in-law of petitioner No.1. The petitioners being ladies have already joined the investigation. It does not appear to be a case of custodial interrogation. 5. Accordingly, the petition is allowed and interim order dated 3.5.2010 is hereby confirmed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer/ trial court subject to the condition that the petitioners will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
