JUDGMENT Sabina, J.:- Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail in case FIR No.35 dated 10.03.2010, under Sections 363, 366, 376, 342, 420, 493, 506, 120-B of Indian Penal Code, Police Station Goindwal Sahib, District Tarn Taran. 2. The allegations against the petitioner are that he had also raped the prosecutrix in the absence of his son Kulwinder Singh. Statement of the prosecutrix was recorded under Section 164 Cr.P.C. 3. Learned counsel for the petitioner has submitted that petitioner is handicapped person. He is innocent and has been falsely involved in this case. Son of the petitioner Kulwinder Singh had performed marriage with respondent No.2 and they lived together as husband and wife for three months. Thereafter, the petitioner as well as his son have been falsely involved in this case. 4. Learned State Counsel, on the other hand, has submitted that the allegations levelled against the petitioner are serious in nature. 5. After hearing learned counsel for the parties, I am of the opinion that the instant petition deserves dismissal as the allegations leveled against the petitioner are serious in nature. The petitioner had allegedly raped the prosecutrix. 6. Accordingly, this petition is dismissed. ------------
