JUDGEMENT 1. Heard the parties. 2. It has been submitted that the petitioner was the Branch Manager in the State Bank of India and he had taken action against some criminal gangs and also got a case instituted against them for intimidation at which he was threatened by them for deposing during trial. For this reason, a bodyguard was also provided to the petitioner. Despite which, the accused persons continued their activities and intimidated the petitioner and thereafter filed the present case in which cognizance has been taken. 3. Even on notice having been issued to the opposite party no. 2 personally, he has not bothered to appear before this court to refute the contentions. 4. Considering the conspectus of the case, the order dated 7.1.2009 passed by the Chief Judicial Magistrate, Patna, in Pirbahor P.S. Case No. 193 of 2001 is hereby quashed. 5. The application stands allowed.
