Judgment :- 1. This transfer civil miscellaneous petition has been filed to withdraw H.M.O.P.No.559 of 2009, from the file of the Subordinate Court, Tambaram, Chennai, and to transfer the same to the file of the Subordinate Court, Valliyur, Tirunelveli District. 2. The petitioner has stated that she is living in Mavadi village, Tirunelveli District. She is living with her aged parents and she has a young child to take care of. The petitioners father is working in the Tamil Nadu Metro Water Supply and Drainage Board, at Tiruneveli District. 3. The petitioner has stated that she has no male member in her family, except her aged father, who is suffering from various ailments. In such circumstances, she would not be in a position to appear before the Subordinate Court, Tambaram, Chennai, in H.M.O.P.No.559 of 2009, filed by the respondent for divorce, under Section 13 (ia) of the Hindu Marriage Act. 4. At this stage of the hearing of the transfer civil miscellaneous petition, the learned counsels appearing for both sides had submitted that it would be convenient for both the petitioner, as well as the respondent to appear before the Subordinate Court, Nagercoil. In such circumstances, the petition in H.M.O.P.No.559 of 2009, pending on the file of the Subordinate Court, Tambaram, Chennai, is withdrawn and transferred to the file of the Subordinate Court, Nagercoil, to be heard and disposed of, in accordance with law. Accordingly, the Transfer civil miscellaneous petition stands allowed. No costs. Consequently, connected M.P.No.1 of 2009 is closed.
