Judgment :- This transfer civil miscellaneous petition has been filed by the petitioner praying that this Court may be pleased to withdraw H.M.O.P.No.1993 of 2009, from the file of the II Additional Family Court, Chennai, and to transfer the same to the Subordinate Court, Srivilliputhur. 2. It has been stated that the marriage between the petitioner and the respondent had been solemnized, on 18.11.2004, according to Hindu rites and customs, at Kovilpatti. A female child was born out of the wedlock, on 23.8.2005. Since, the respondent had been leading an immoral life, the petitioner had started questioning his behaviour. Thereafter, the respondent had thrown out the petitioner and her minor child from the matrimonial home. 3. It has also been stated that, after leaving the matrimonial home, the petitioner has been living with her mother, along with the minor child, at Srivilliputhur. While so, the respondent had filed an original petition, in H.M.O.P.No.1993 of 2009, on the file of the II Additional Family Court, Chennai, for divorce, on the grounds of cruelty and desertion. 4. It has been further stated that the petitioner is a native of Srivilliputhur and that she is residing with her mother. The petitioner has no income of her own and that she has to spend a huge amount of money towards travel expenses, to attend the hearings before the Family Court, Chennai. Further, she has no one to accompany her during her travel and stay at Chennai. Further, the petitioner has been finding it extremely difficult to leave her minor child at Srivilliputhur during her visits to Chennai, to attend the hearings before the II Additional Family Court, Chennai. 5. There is no appearance on behalf of the respondent. No counter affidavit has been filed on behalf of the respondent. 6. In view of the averments made on behalf of the petitioner, H.M.O.P.No.1993 of 2009, is withdrawn from the file of the II Additional Family Court, Chennai, and transferred to the file of the Subordinate Court, Srivilliputhur, as prayed for by the petitioner, in the present transfer civil miscellaneous petition. No costs.
