Hon'ble Shashi Kant Gupta, J. : Heard learned counsel for the applicant, learned A.G.A. and perused the record. 2. It is submitted by learned counsel for the applicant that? the applicant is innocent and has been falsely implicated.?? He further submits that no offence under Sections 420 and 406 IPC is made out against the applicant.? He further submits that complete procedure for the trial of offences under Section 138 of the Negotiable? Instruments Act has been given in the Chapter XVII of the said Act and the offence under Section 138 of the said Act is cognizable only upon a complaint in writing.? The applicant is in jail since 9.4.2010. 3. Keeping in view the nature of the offence, evidence, complicity of the accused, severity of punishment,? submissions of the learned counsel for the parties and without expressing any opinion on the merits of the case, the applicant has made out a case for bail. 4. Let the applicant Anjani Kumar Jha involved in Case Crime No. 302 of 2010, under Sections 420, 406? I.P.C. and Section 138 of the Negotiable Instruments Act, P.S. Sector-20 Noida, District Gautam Budh Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions: (i) The applicant will not tamper with the evidence during the trial. (ii) The applicant will not pressurise/intimidate the prosecution witness. (iii) The applicant will appear before the trial court on the date fixed. (iv) The applicant shall report to the police station concerned in the first week of each month to show his good conduct and behavior. 5. In case of breach of any of the above conditions , the court below shall be at liberty to cancel the bail. _____________
