Judgment :- 1. This civil revision petition is filed seeking a direction to the Additional Subordinate Judge, Coimbatore, to dispose of the E.P.(CFR) No.14270/2008, pending on his file. 2. Heard the learned counsel for the petitioner. The relevant facts which he would like to narrate are as under: (i) The revision petitioner herein is the holder of the decree for recovery of money as against the original debtor Manicka Asari, who subsequently died during the pendency of the first E.P. No.23 of 2010 filed before the second Additional Sub Court, Coimbatore. Since the LRs were not brought on record within a reasonable time, that E.P. was dismissed for default. (ii) Whereupon the revision petitioner/decree holder has chosen to file a fresh E.P.,impleading the LRs, which is legally permissible under law, as after the passing of the decree, the question of abatement and all would not arise. 3. The learned counsel for the petitioner would echo the cri de coeur of the petitioner/decree holder that the Court office is searching for the first E.P. bundle, so as to number the second E.P. and despite compliant having been lodged with the Principal District Judge concerned, nothing emerged. 4. I am of the opinion that this is the case which should be interfered with by this Court and suitable direction should be given. Simply because the first E.P.bundle could not be traced, the Court office is not justified in keeping the second E.P. without numbering. With the available records and the entries made in the Suit Register and the E.P.Register the fresh E.P. should be numbered and processed as per law. 5. Accordingly direction is given to the II Additional Subordinate Judge, Coimbatore to number the E.P.(CFR) No.14270 of 2008, if it is otherwise in order and process the same as per law. The Principal District Judge, Coimbatore, shall monitor the same. The civil revision petition is ordered accordingly. No costs. Connected miscellaneous petition is closed.
