Judgment :- Elipe Dharma Rao, J. 1. When the matters came up for hearing today, learned senior counsel appearing for the petitioner submitted that the Director of Environment and Member Secretary, State Level Environment Impact Assessment Authority, Tamil Nadu has granted environmental clearance to the petitioner by order dated 04.06.2010 and therefore the deficiency pointed out by the Tamil Nadu Pollution Control Board for closure of the petitioner CETP by order dated 18.01.2010 is rectified. On the other hand, learned counsel appearing for the Board submitted that after obtaining the environmental clearance from the State Level Environment Impact Assessment Authority, the petitioner should approach the Board for obtaining necessary orders in that regard. In response to the submission made by the learned counsel appearing for the Board, learned senior counsel for the petitioner submitted that the petitioner is ready to approach the Board with all materials for obtaining necessary orders. 2. Having regard to the submissions made by the learned counsel appearing on either side and without expressing any opinion on the merits of the case, we consider it appropriate to direct the petitioner to approach the Board with an appropriate application on or before 23.06.2010 seeking for necessary orders in that regard and on such application being received, the Board is directed to consider the same with notice to third respondent and pass appropriate orders in accordance with law, within a period of three weeks from the date of receipt of a copy of this order, after giving an opportunity to the third respondent. Till such time, the interim order granted by this court on 12.02.2010 shall continue to be in force. 3. With the above direction, these writ petitions are disposed of. No costs. Connected miscellaneous petitions are closed.
