JUDGEMENT Akhilesh Chandra, J. 1. Heard learned Counsel for the Petitioner and learned Additional Public Prosecutor for the State. None appeared on behalf of opposite party No. 2. 2. This is an application seeking quashing of order dated 03.02.2000 passed in Complaint Case No. 596 C of 1997 by Sri D.P. Jaiswal, Judicial Magistrate, first class, Munger, taking cognizance under Sections 323 and 380 of the Indian Penal Code. 3. During the course of arguments, it is submitted on behalf of the Petitioner that parties have already settled their dispute and, accordingly, petition for compromise was filed on 07.08.2006 duly signed by the parties and their respective counsels but since further proceedings before the court below has already been stayed vide order dated 21.07.2005 passed in this application, nothing happened there. 4. In view of the above, the court below is directed to pass appropriate order on the petition of compromise filed by the parties at the earliest. 5. With the above direction and observation, this application stands disposed of. The interim order dated 21.07.2005 automatically stands vacated. 6. This order may be communicated through FAX to the court below at the cost of the Petitioner.
