JUDGEMENT Akhilesh Chandra, J. 1. Heard learned Counsel for the Petitioner and learned Additional Public Prosecutor for the State. None appeared on behalf of the complainant opposite party No. 2 inspite of earlier appearance since the stage of admission of this application for hearing. 2. This is an application under Section 482 of the Code of Criminal Procedure seeking quashing of order dated 12.03.2004 passed by Sri S.K. Sinha, Judicial Magistrate, Khagaria, in Complaint Case No. 330C of 2003 taking cognizance for the offences under Section 420, 465 and 468 of the Indian Penal Code. 3. After some arguments, learned Counsel for the Petitioners seeks permission to withdraw this application with a liberty to agitate all his points including pendency of two civil suits relating to inter-se transactions before the trial court at appropriate stage preferably at the time of hearing on the point of charge after getting the witnesses examined before charge, cross-examine. 4. Permission is granted. 5. Accordingly, this application is disposed of with the above liberty.
