In terms of the Order dated 18.12.2009, the record of the Divisional Forum Jammu (herein after be referred as Forum) was called for today's hearing but the record has not been received. In pursuance to the direction issued to the appellant, he has produced original record of certificate of permanent registration issued by the District Industries Central, Jammu. (Copy whereof has been placed on the record). The record reveals that the Partnership Private Limited Firm stands registered in the name of Shri Ved Prakash who is shown as the proprietor whereof. In the impugned order the name of the said proprietor has been shown as Ved Pal Sharma, Proprietor, Jammu Photo Colour Lab, Bari Brahmana, Jammu. The impugned order reveals that he was shown absent from the proceedings because of the postal receipt placed on the record bearing No. RLAD A 1947, dated 01.03.2006 2. The short controversy here is that according to the appellant he has not been heard in the proceedings because no notice was issued in his name which is Ved Prakash. He has to contest the case on merits. He has been denied a chance to defend his case so natural justice has been denied to him by impleading him in the wrong name. The ex parte award obtained against him is therefore not binding upon him. 3. The counsel of the appellant and also the OP have been heard. It is an admitted case of denial of natural justice because award has been passed against the wrongly named proprietor of M/S Jammu Photo Colour Lab Bari Brahmana, Jammu and has no binding effect on the appellant. In this view of the matter, the appeal is accepted and the impugned order is set aside. In case the respondent chooses so he is at liberty to initiate fresh proceedings against the appellant in case the law permits him. The appeal is accepted. The file is consigned to records. The copy of this order be sent to the Forum for placing on the record of complaint No. 808 of 2006, titled Prem Chand S/O Shri Krishan Lal R/O Meen Charkan, Tehsil Samba, District Jammu v. Shri Ved Pal Sharma (Proprietor) M/S Jammu Photo Colour Lab. Main Chowk, Bari Brahmana, Jammu. The amount deposited by the appellant before the Forum be returned to him at once by the Forum.
