JUDGEMENT S.K.Sharma and D.K.Singh JJ. 1. This appeal has been filed by sole Appellant Chunu Singh alias Ajay Singh against the judgment dated 21.12.1987 by which he has been convicted under Section 302 of the Indian Penal Code and has been sentenced to undergo life imprisonment in Sessions Trial No. 256 of 1986 arising out of Arrah Town P.S. Case No. 188 of 1985 by 9th Additional Sessions Judge, Arrah. 2. It has been submitted by learned Counsel for the Appellant that the sole Appellant Chunu Singh alias Ajay Singh son of Rabindra Singh, resident of Tari Mohalla, P.S. Arrah Town, district Bhojpur, a convict of Sessions Trial No. 256 of 1986 is already dead. It has further been submitted that similar information was given to this Court on various occasions and this Court had called for report from the concerned officials. The report does not specifically mention regarding death but only inference which can be drawn from the report is that Appellant Chunu Singh alias Ajay Singh had been killed somewhere in the district of Rohtas about 10 to 14 years ago. 3. Perused the report. Heard the submissions. The report of the Superintendent of Police, Bhojpur indicates that, on query, the police has come to the opinion that the sole Appellant was killed. 4. In view of the submission and the report, the appeal abates. Accordingly, this appeal is disposed of.
