JUDGEMENT 1. Heard learned counsel for the petitioners and learned counsel for the Bihar School Examination Board. 2. The relief prayed for is to be permitted to appear at the Intermediate examination to be held in 2010. 3. The petitioners are stated to be the students of the institution in question. A counter affidavit has been filed on behalf of the respondent Board. On perusal of the same, more particularly the order dated 7.1.2010, Annexure-A, this Court finds it difficult to give any directions to the Board to permit the petitioners to appear. Serious questions of facts appear to be involved. 4. In that view of the matter, the writ application is disposed of in similar terms as C.W.J.C. No. 3297/10 in light of very fair stand taken on behalf of the Board to suitably examine matters of conducting of a special examination etc., if circumstances so warrant. 5. The writ application, stands disosed.
