JUDGMENT Mr. M.M.S. Bedi, J. (Oral):- The petitioner is alleged to have sold 7 drums of Kerosene oil in violation of terms of Licence. 2. Recoveries having already been made, the petitioner was asked to join the investigation vide interim order dated 01.09.2010. 3. It has been informed that the petitioner has already joined the investigation. 4. At this stage, Mr.Aminder Singh, Advocate, on behalf of few villagers has put in appearance to contend that the petitioner after having been involved in the case had attacked the said villagers with a vindictive mind to teach them a lesson for giving information to the Food and Supply Department regarding illegal activities of the petitioner. 5. It has been informed that a cross-case regarding assault on each other has been registered against two parties. However, the petitioner is not accused in the said case. 6. Without expression of any opinion whether the petitioner had been instrumental for the other criminal case, the petitioner can be granted the concession of pre-arrest bail in the present case under the Essential Commodities Act. 7. The petition is allowed. Interim order dated 01.09.2010, is hereby made absolute subject to the following conditions: - (i) That the petitioner will join the investigation as and when required by the police; (ii) That the petitioner will not tamper with the evidence and hamper the investigation, in any manner; (iii) That he will not take any offensive steps against Gurbhej Singh, Sukhwinder Singh, Sahib Singh, Teja Singh, Bhura Singh and Gurmail Singh; and (iv) That the petitioner will not commit the similar offence of which he is accused of; In case of violation of any of the above said conditions, it will be open to the prosecution Agency and the persons named hereinabove to approach this Court for cancellation of bail. ————————
