By The Court—Heard learned counsel for parties and perused the pleadings of writ petition.2. There is a consensus between learned counsel for parties that the instant case would be governed by the ratio of judgment of the Apex Court reported in AIR 1995 SC 1078 (Election Commission of India Vs. State Bank of India). There is also a consensus that even though an amendment was introduced in the Representation of Peoples Act after the judgment but there is no corresponding amendment made in the provisions of U.P. Panchayat Raj Act, 1947.3. Thus, we dispose of this writ petition with a direction that the staff of petitioners namely Allahabad U.P. Gramin Bank shall be treated to be exempted from the election duties.4. This writ petition stands disposed of._____________
