JUDGMENT 1. - With the consent of parties, the matter is finally decided at this stage. 2. Petitioner was initially appointed as LDC after his regular selection on 4th March, 1978 and was confirmed in the cadre w.e.f. 5th March, 1979. However, after he retired from service, the respondent has taken note of service which he rendered after being confirmed in the cadre w.e.f. 5th March, 1979 and the services rendered prior thereto have been obliterated for computing his pension to which he is otherwise entitled for under law. 3. Counsel placed reliance on the judgment of this Court in Rajendra Nath Sharma v. State of Rajasthan, 2005 (2) CDR 1131 (Raj.) and which was also taken note of in the later judgment in Balwant Singh v. State of Raj. & Anr., 2008 (2) WLC (Raj.) 582 . This fact has not been controverted by the respondents in the light of judgments referred to supra. 4. Accordingly, present writ petition stands disposed of and the respondents are directed to consider the qualifying service rendered from the date of initial appointment i.e. 04/03/78 and accordingly, retiral benefits be computed and arrears be paid along with interest @9% p.a. from the date it became due till its actual payment in terms of R.89 of Rules, 1996. Respondents shall ensure compliance within three months. No costs. *******
