ORDER : 1. Taken on board. 2. This application is filed by Ministry of Defence/Border Road Organisation seeking permission for the upgradation/construction of the road between track junction-Bheem Base-Dokala and for an alternate road between Flag Hill-Dokala passing through Pangolakha Wildlife Santuary in Sikkim. 3. The CEC has examined the feasibility and filed a Report that the clearance could be given subject to the following conditions: (i) for the use of the forest land, approval under the FC Act will be obtained and the NPV as per the rates applicable for the use of the forest land falling within the Sanctuary, will be deposited. (ii) for the use of the area falling within the Sanctuary, approval of the Standing Committee of the National Board for Wildlife will be obtained. (iii) the conditions on which the project has been recommended by the Sikkim Forest Department will be strictly complied with (as given in Annexure R-3 to this Report). (iv) 5% of the estimated project cost of Rs. 71.40 crore (i.e. Rs. 3.570 crore) will be deposited in the compensatory afforestation for undertaking the conservation and protection works in the Pangolakha Wildlife Sanctuary. (v) the mitigative measures for the conservation and protection of Pangolakha Wildlife Sanctuary will be undertaken as per the Annual Plan of Operation prepared in this regard by the Sikkim Forest Department (enclosed as Annexure R-4 to this Report). The funds required for this purpose will be released by the Ad-hoc CAMPA to the Sikkim Forest Department out of the amount deposited by the user agency towards the NPV and 5% of the project cost. 4. The above conditions are acceptable to the Ministry of Defence/Border Road Organisation. 5. The project is cleared subject to fulfilling of the above mentioned conditions. 6. I.A. is allowed accordingly.
