Judgment :- This Writ Petition has been filed praying for a Writ of Certiorarified Mandamus to call for the records relating to the impugned order of the second respondent dated 20.07.2009, and to direct the respondents to approve the plan submitted by the petitioner for the proposed construction of Ground+1st Floor building in Plot No.2, T.S.No.3/18, Block No.22, situated at Lakshmi Ammal Street, Ayyavu Colony, Aminjikarai, Chennai- 600 029. 2. At this stage of the hearing of this Writ Petition, Mr.V.Bharathidasan, learned counsel appearing on behalf of the respondents had submitted that the Impugned Order passed by the second respondent dated 20.07.2009 is without the jurisdiction, as the Corporation of Chennai is not authorised to grant building plan approval as per the circular No.RT/5039/2008-A, dated 04.09.2008. 3. In view of the said submissions made by the learned counsel appearing on behalf of the respondents, the Impugned Order of the second respondent dated 20.07.2009 is set aside. However, it is made clear that, it is open to the petitioner to approach CMDA for approval of the building plan as per law. Accordingly, this Writ Petition is disposed of. No costs. Consequently, Connected Miscellaneous Petition is closed.
