Judgment :- This petition has been filed to withdraw G.W.O.P.12 of 2009, on the file of the Principal District Court, Perambalur and to transfer the same to the file of the family Court at Chennai. 2. The petitioner has stated that she had married the respondent, on 10.03.2004,at Chennai and out of the wedlock, a girl child was born to the petitioner, on 04.01.2005. However, certain disputes had arisen between the petitioner and the respondent, thereafter. Since, the respondent was physically and mentally abusing the petitioner, she was forced to live with her mother at Pudupakkam, Royapettah,Chennai. While so, the respondent had filed G.W.O.P.No.12 of 2009, on the file of the Principal District Court, Perambalur. 3. The petitioner has also stated that she has to travel to Perambalur to attend the hearings, in G.W.O.P.No.12 of 2009, without any help from her aged mother. There is no male member in the family to accompany her, as her father had already died. The petitioner has to take along with her, the five year old child, while attending the hearings, in G.W.O.P.No.12 of 2009, pending on the file of Principal District Court, Perambalur. It has also been stated that the petitioner has severe disc displacement in her back bone and she has undergone a surgery due to the said problem. Therefore, it is difficult for her to travel long distances. 3. There is no representation on behalf of the respondent. No counter affidavit has been filed on behalf of the respondent. 4. In view of the averments made on behalf of the petitioner, G.W.O.P.No.12 of 2009, pending on the file of the Principal District Court, Perambalur, is withdrawn and it is transferred to the family Court at Chennai, as prayed for by the petitioner. Accordingly, this Transfer Civil Miscellaneous Petition is allowed. No costs.
