Judgment :- This Civil Revision Petition has been filed praying, to set aside the order, in Interlocutory Application No.315 of 2009, in Original Suit No.99 of 2009, passed by Subordinate Court, Tirupur, dated 28.08.2009. 2. At this stage of the hearing of the Civil Revision Petition, the learned counsel appearing on behalf of the respondents had submitted that this Civil Revision Petition is not maintainable, since an appeal remedy is available to the petitioner. 3. The said submission made by the learned counsel appearing on behalf of the respondent had not been refuted by the learned counsel appearing for the petitioner. 4. In such circumstances, this Civil Revision Petition stands dismissed. No costs. However, it goes without saying that it would be open to the petitioner to avail the appropriate Appellate remedy, before the appropriate forum, in the manner known to law. Consequently, connected Miscellaneous Petition is closed.
