Judgment : In the light of the notification dated 5-3-2010 enclosed to the memo dated 11-3-2010 of the State, conferring powers on the Regional Commissioners including the one at Mysore to decide the complaint of disqualification on the ground of defection under subsection (1) of Section 4 of the Karnataka Local Authorities (Prohibition of Defection) Act, 1987, the order dated 25-2-2010 Annexure-J of the third respondent-Regional Commissioner, Mysore Division stands quashed. 2. The third respondent is directed to consider the petitioner’s complaint exercising powers conferred on him pursuant to the notification supra and to pass orders on the petitioners complaint in accordance with law. It is needless to state that if any application is filed before the Commissioner for interim directions, the Regional Commissioner is directed to consider the same and pass orders thereon in accordance with law. Interim order stands dissolved.
