Heard Standing Counsel for the State. 2. Learned Counsel for the appellant is not present in the revised call. 3. The matter had been adjourned yesterday at the request of the learned Standing Counsel to produce the concerned relevant Government Order relating to the disqualification, which is a subject matter of issue in this Special Appeal. Learned Standing Counsel has produce the Govern­ment Order dated 16th December, 2003. 4. The disqualification prescribed in Clause 7 of the said Government Order is quoted herein below : 5. The appellant was already an elected member of the Gaon Sabha on the date of selection. She has later on tendered her resignation. The aforesaid prescription disqualified a person to hold an office and function as Anganbari Worker. Had the appellant resigned earlier to her selection, then the situation would have been different. In view of the aforesaid position, there is no merit in this appeal. Appeal stands dismissed.
