JUDGMENT 1. - The learned counsel for the petitioner has contended that but for the fact that the petitioner happens to be a friend of Vikram Singh and Ravi, the main accused in the case, there is hardly any evidence against the present petitioner. The only allegation against the present petitioner is that he has obscene pictures involving the prosecutrix on his mobile. But, there is no evidence to show his involvement in the alleged offence. 2. On the other hand, the learned Public Prosecutor has read out the statement of Dharmendra and Sunil, both the of whom claims that the present petitioner is the friend of Vikram Singh and Ravi, the accused in this case, and once they had told that they had obscene pictures involving the prosecutrix. 3. Without expressing any opinion on the merits and demerits of the case, but looking to the totality of the facts and circumstances of the case, this Court is inclined to grant the bail application of the petitioner under Section 439 Cr.P.C.It is, therefore, ordered that the petitioner, Umesh @ Sonu S/o Shree Gulab Chand Sankhala, shall be released on bail provided he furnishes a personal bond in the sum of Rs. 30,000/- (Rs. Thirty Thousand) with two sureties of the same amount to the satisfaction of the learned trial Court for his appearance before the trial court as and when he is called upon to do so.However, The petitioner is directed to appear before the concerned Police Station on every Monday of the month during the course of trial. In case the petitioner violates this condition, the State shall be free to move an application for cancellation of the bail granted by this Court. *******
