Judgment Gurdev Singh, J. 1. Petitioner-Rajwinder Kaur wife of Jaswinder Singh has filed this petitioner under Section 439 of the Criminal Procedure Code, for grant of regular bail in FIR No. 124 dated 15.5.2009 registered at Police Station Sadar Khanna, Ludhiana, under Section 302, 307, 452 150-B/34 IPC. 2. This FIR was registered on the statement of Harbans Kaur wife of the deceased and mother-in-law of the petitioner. According to her, the petitioner was having illicit relations with her co-accused Jaspreet Singh @ Jassa and that on the night of occurrence when the murder of the deceased was committed, she did not come out of the bed room and that this murder was committed at her instigation. 3. The petitioner coming in custody since 17.5.2009. Only the accusation of abetment for murder is being levelled against her. Though according to the State counsel, challan has already been presented in court no progress has been made in the trial. The conclusion of the trial likely to take some time. Being woman, there is an additional factor in favour of the petitioner for the grant of bail. 4. Keeping in view the above facts and without expressing any opinion on the merit of the case, this application is allowed. The petitioner is admitted to bail to the satisfaction of the trial court/Chief Judicial Magistrate, Ludhiana.
